Welcome to the Clinic Launch Academy Mobile App ("the App"), a proprietary white-label version of the GoHighLevel ("GHL") platform with additional features, tools, automations, training modules, CRM enhancements, and resources provided by Clinic Launch Academy ("CLA", "we", "our", "us").
IMPORTANT: This App is a business management tool for facilitating B2B connections in the healthcare industry. It is not a medical device, diagnostic tool, or patient care system.
By downloading, accessing, or using the App, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the App.
1. Acceptance of Terms
By creating an account or using the App, you confirm that:
- You are at least 18 years old
- You have legal authority to bind yourself or your organization
- You have read, understood, and agree to these Terms & Conditions
- You will comply with all applicable laws and regulations
These Terms apply to all users, including businesses, staff members, contractors, and team members.
2. Nature of the App
The App is a white-label version of GoHighLevel and includes:
- CRM and contact management tools
- Pipeline and sales tracking
- Email/SMS communication capabilities
- Appointment scheduling
- Sales funnels and workflows
- Marketing automation features
- Training and educational content
- Business analytics and reporting
- Custom features developed by CLA
All core infrastructure, hosting, and backend systems are powered by GoHighLevel, while customizations, templates, training, and business systems are provided by Clinic Launch Academy.
3. Business Facilitation Services
CLA provides tools and training for business development and B2B connections. We do not:
- Provide medical, legal, or professional advice
- Guarantee business results or income
- Ensure regulatory compliance (unless contracted separately)
- Act as a party to transactions between users
Users are solely responsible for:
- Their business decisions and outcomes
- Compliance with industry regulations
- Professional standards and licensing
- All client and business relationships
4. User Accounts & Access
You are responsible for:
- Maintaining confidentiality of login credentials
- All activity under your account
- Ensuring authorized use by team members
- Promptly notifying us of unauthorized access
We may suspend or terminate access if:
- Terms violations are detected
- Security risks are identified
- Payment obligations are not met
- Fraudulent activity is suspected
5. Payments, Billing & Refunds
If your App access is part of a subscription or service agreement:
- All fees must be paid on time
- Payment methods must remain valid
- Fees are non-refundable unless stated in writing
- Taxes are your responsibility
Failure to pay may result in immediate suspension or termination.
6. Use of Communication Tools
The App includes email, SMS, and messaging capabilities. You agree to:
- Comply with TCPA, CAN-SPAM, GDPR, and all applicable laws
- Obtain proper consent before contacting individuals
- Not send spam, misleading, or harmful content
- Maintain accurate opt-out mechanisms
- Accept responsibility for all sent communications
CLA is not liable for:
- Communication delivery failures
- Carrier or provider charges
- Compliance violations from your usage
7. Data, Privacy & Security
Your use of the App involves:
- Data storage on GoHighLevel infrastructure
- Processing according to our Privacy Policy
- Your responsibility for data compliance
You must:
- Ensure lawful data collection and use
- Maintain appropriate security measures
- Obtain necessary consents
- Comply with applicable privacy laws
8. Intellectual Property
All CLA-provided content, including but not limited to:
- Templates and workflows
- Training materials and courses
- Automations and scripts
- Documentation and guides
- Branding and creative assets
Remains the exclusive property of Clinic Launch Academy. You receive a limited, non-transferable license during your active subscription. You may not resell, redistribute, or commercially exploit CLA materials without written permission.
9. Acceptable Use Policy
You may not:
- Use the App for illegal purposes
- Violate any applicable laws or regulations
- Interfere with App functionality or security
- Attempt unauthorized access
- Reverse engineer or copy the App
- Harass, harm, or defraud others
- Transmit malicious code or content
- Violate third-party rights
10. Service Modifications
We reserve the right to:
- Update or modify App features
- Change pricing or access levels
- Add or remove functionality
- Modify these Terms
Changes may occur with or without notice. Continued use constitutes acceptance of modifications.
11. Third-Party Services
The App may integrate with third-party services including:
- Payment processors
- Communication providers
- Analytics tools
- Cloud services
We are not responsible for third-party:
- Service interruptions
- Data handling practices
- Terms and policies
- Fees or charges
12. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR COMPLETENESS
We do not guarantee:
- Uninterrupted or error-free operation
- Specific business results
- Income or revenue levels
- Third-party service availability
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLA SHALL NOT BE LIABLE FOR:
- INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
- LOST PROFITS OR BUSINESS OPPORTUNITIES
- DATA LOSS OR CORRUPTION
- THIRD-PARTY CLAIMS
- DAMAGES EXCEEDING FEES PAID IN THE PRECEDING 12 MONTHS
This limitation applies regardless of the theory of liability.
14. Indemnification
You agree to indemnify and hold harmless CLA, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the App
- Violation of these Terms
- Violation of any laws or third-party rights
- Your business activities
15. FDA & FTC Compliance
- No claims have been evaluated by the FDA
- Results vary based on individual effort and market conditions
- Income representations are not guarantees
- Testimonials reflect individual experiences, not typical results
16. Termination
Either party may terminate these Terms:
- By you: Cancel subscription anytime
- By us: For Terms violations or non-payment
Upon termination:
- Access to the App ceases immediately
- Licenses to CLA content expire
- Data may be deleted per our retention policy
17. Dispute Resolution
Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except where prohibited by law. You waive the right to participate in class actions.
18. App Store Terms
This App is also subject to:
- Apple App Store Terms of Service
- Google Play Store Terms of Service
- Platform-specific guidelines
These platform terms supersede conflicting provisions herein.
19. Governing Law
These Terms are governed by the laws of California, United States, without regard to conflict of law principles.
20. General Provisions
- Entire Agreement: These Terms constitute the complete agreement
- Severability: Invalid provisions don't affect remaining Terms
- No Waiver: Failure to enforce doesn't waive rights
- Assignment: You may not assign these Terms
